1.        CHECK-IN TIME IS 3:00 P.M. – Keys are NOT available until the property is ready for occupancy.  Owner will work with Guest to make arrangements for Guest to obtain keys.

2.        CHECK-OUT TIME IS 10:00 A.M. - Owner will work with Guest to make arrangements for keys to be returned to Owner.  Guests that do not vacate the rental property by 10:00 a.m. may be assessed a fee equal to the rental rate for one (1) night.

3.        RESERVATION REQUIREMENTS  50 % of the total rental fee is required in advance to hold the reservation.  The Vacation Rental Agreement (this document) must be signed by Guest and returned to owner with the deposit.  Owner accepts money orders, cashiers check, personal checks, and PayPal (  Payment must be received within 4 business days of making the reservation to secure the reservation.  Upon receipt of the signed contract and deposit, the owner will return a signed copy of the contract by mail or fax.  The balance of the rental fee (plus security deposit and cleaning fee) is due in full 10 business days before check-in(Due 30 days in advance if paying by personal check).  Upon receipt of full payment, confirmation and directions will be mailed, faxed, or emailed to Guest.

4.        SECURITY DEPOSITDamage deposit equal to one (1) night’s rental is required 10 business days before check-in.  Owner accepts money orders, cashiers check, personal checks, and PayPal (  (Due 30 days in advance if paying by personal check.)  The security deposit will be returned within 10 business days of the check-out date provided the keys are returned to owner per agreement and there is no breakage or damage to the premises and/or contents, outstanding long distance telephone charges, or cleaning costs, other than those normally incurred in connection with the occupancy of the premises.  The security deposit will be returned by check to the address specified by the Guest at the time of reservation.  Each Guest will be financially responsible for damage done to the property.  If there is damage to the property or its contents, the Guest will be notified of any excessive cleaning needed or damages made and the amount will be deducted from the security deposit.  If the amount of the damages exceeds the amount of the security deposit, the Guest agrees to reimburse the owner for the difference between the security deposit and the amount of damages.  Valuation of the damages will be at the sole discretion of the Owners.  Owners agree to assess damages at a fair and reasonable value based on the cleaning, repairs, or replacements necessitated by the damage.

5.        CANCELLATIONA $20.00 administration fee will be charged for all cancellations.  Cancellations must be made in writing and received by owners at least 30 days prior to the check-in date.  Owner will refund all deposits minus $20.00 administration fee upon receipt of cancellation notice.  Refunded deposits will be returned by check to the address specified by the Guest at the time of reservation.  If guest cancels within 30 days of check-in date, all deposits will be forfeited to the Owner unless the property can be rented to another party for the same reservation dates and at the same rental rate as agreed upon by Owner and Guest.  In the unlikely event that the Owners must request that a reservation be cancelled, at least 90 days notice of the cancellation will be given and all deposits will be fully refunded.

6.        RETURNED CHECKS – A $35.00 service charge will be incurred for any returned checks.

8.        CONFIRMATION – Upon receipt of full payment, confirmation and directions will be mailed, faxed, or emailed to Guest.  Please read the confirmation to confirm accuracy of dates, mailing address, number of guests.  Occupancy is limited to REGISTERED GUESTS ONLY.  Absolutely no overnight visitors are allowed.  In the event this occurs, your security deposit and rent will be forfeited and you will be asked to vacate the property.


10.     KEYS – Keys must be returned to Owner upon check out.  Owner will work with Guest to arrange for the return of the key.  Guest is responsible for lost keys.  The property must be re-keyed in the event that keys are lost or misplaced.  Guest will be responsible for the cost of this procedure.

11.     Cable television – Property is equipped with basic cable television.  Guest is liable for ordering any pay per view programming.  Programming charge plus an additional $10 per program or event will be deducted from your security deposit.

12.     Phone CallsGuest agrees to make all long distance calls with a calling card.  If Guest charges long distance phone calls to Owner’s phone, Guest will be liable for said charges plus a charge of $10 per call.

13.     FirePlaces – Fireplaces are seasonal and are not to be used from May 1st through September 30th.  Failure to obey this rule will result in loss of security deposit.

14.     FIREWOODOwner is not obligated to provide firewood for the rental.  Firewood MAY be available at the property.  If wood is available, guest may use a reasonable amount of firewood.  If wood is not available at the property, it can be obtained from local markets at reasonable rates.

15.     SMOKING Smoking is not permitted inside the property.  Outside smoking is permitted, but please do not litter.  Failure to obey this rule will result in loss of security deposit.

16.     Alcohol and drugs Illegal drug use is strictly prohibited.  Kegs are not permitted at the property.  Failure to obey this rule will result in loss of security deposit.

17.     PetsNO PETS ARE ALLOWED ON THE PROPERTY WITHOUT EXPRESS WRITTEN PERMISSION FROM THE OWNER.  If owner determines that pets are present or have been present at the property, your security deposit and rent will be forfeited and you will be evicted immediately.

18.     Furnishings / equipment / etc. – Under no circumstances are furniture, bedding, equipment, utensils, or any other property supplied with the rental property to be taken out of the property.  Loss or damage to any furnishings will be charged against the security deposit.

19.     Owner’s closets Certain areas of the property are locked for the Owners’ personal storage and are not to be accessed by the Guest.  These areas include: (1) the small closet in the master bedroom and (2) the utility closet at the end of the hall on the lower level.  In the event that the Guest needs to gain access to the utility closet due to an emergency or unusual circumstance (e.g. breaker switch, turn off water supply, etc.), Guest should contact Owner at XXX-XXX-XXXX.  Owner will provide direction on how to handle the situation.  If Guest accesses the Owner’s closets without Owner permission, the security deposit will be forfeited, and guest will be evicted immediately.

20.     LINENs / suppliesA basic supply of linens is provided for the rental property including towels, washcloths, bed linens, and dish towels.  Linens will not be changed or replaced during your stay.  Startup supplies (including soap, toilet tissue, and trash bags) will not be replenished during your stay.

21.     Cleaning REquirementsGuest is required to leave the property in the same general condition it was in when Guest arrived.  Dishes should be cleaned and put away.  Beds should be stripped of linens; towels and linens should be left in a pile in front of the washing machine on the lower level.  Guest is responsible for any damage, abuse, excessive cleanup requirements, or loss caused by any member of Guest’s party to the property or its contents.  Owners will inspect the property after checkout to ensure the property is left in good order.  Owner will make final determination of the necessity of any charges to Guest.

22.     Checkout proceduresThe following items must be complied with prior to check out in order for Guest to receive his/her security deposit: 

a.       Dishes, pots, pans, silverware, and utensils must be washed, dried and put away (Do Not Leave in Dishwasher) and the stove/oven must be left in a clean condition.

b.       Refrigerator should be left clean and free of food.

c.      Windows and doors must be left closed and locked with all (3) thermostats set on 80 degrees (summer) or 55 degrees (winter).

d.       Hot tub temperature must be set at 85 degrees.

e.        All trash must be placed in outside garbage can.

f.        Keys must be returned to owner according to owner instructions.

23.     Repairs – Service callsOwner cannot guarantee against mechanical failure of heating, air conditioning, hot tub, TVs, or other appliances.  Also, owner cannot guarantee against temporary outages of electrical service, cable service, water service, phone service, or other services.  In the case of a failure or outage, owner will make every reasonable effort to have repairs performed or service restored as quickly and efficiently as possible.  No refunds or rent reductions will be made due to failure of appliances or services.  All problems or service requests should be reported to the owner immediately using the contact information on the first page of this contract.

24.     Acts of god / 3rd party disturbances Owners shall not be liable for events beyond their control which may interfere with Guest occupancy including, but not limited to, Acts of God, inclement weather, or activities of 3rd parties (e.g. neighbors, etc.).  No refunds or rent reductions will be made under these circumstances.

25.     House PartiesHouse parties are not allowed!  Guest understands that owner will rent to families and groups of responsible adults over the age of 21.  Guest agrees that more than the number of people stated on the lease shall not occupy the premises.  Occupancy and use of premises shall not be such as to disturb or offend neighbors.  Guest agrees to keep all music and noise to a reasonable volume that will not disturb the neighbors.  The use of firearms or fireworks is strictly prohibited.  Failure to adhere to this policy will result in immediate eviction, forfeiture of total rent and security deposit, and additional charge to adequately compensate for additional guests.

26.     No trespassing on neighboring propertyGuest agrees not to trespass on neighboring residential property or docks.  This includes the land directly in front of the dock (follow path from cabin to dock).   Failure to obey this rule may result in immediate eviction and forfeiture of total rent and security deposit.

27.     Right of EntryGuest agrees that the Owner reserves the right to enter the rental property at anytime to investigate disturbances, check occupancy, check for damage, perform repairs/improvements or for any reason as Owner deems appropriate.

28.     Expedited EvictionA material breach of this Agreement by Guest which, in the sole determination of the Owner, results in damage to the property, personal injury to Guest or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest tenancy.  Violation of any of the rules contained herein will result in immediate eviction and forfeiture of rent and security deposit.  Any reservation made under false pretenses will also result in immediate eviction and forfeiture of rent and security deposit.

29.     indemnification and hold harmlessGuest agrees to indemnify and save harmless the Owner for any liabilities, theft, damage, cost, or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest use and occupancy of the property including, but not limited to, any claim or liability for personal injury or damage or theft of property which is made, incurred, or sustained by Guest.  The term “Owner” as used in this Agreement shall include heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits.  The term “Guest”, “You”, and “Your” as used in this Agreement shall include Guest, heirs, successors, assigns, guests, invitees, representatives, and other persons on the rental property during Guest occupancy (without regard to whether such persons have authority under this Agreement to be upon the rental property), where the context requires or permits.

30.     DisputesThis Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as thou it were executed in the County of Dawson, State of Georgia.  Any action relating to this Agreement shall be instituted and prosecuted only in the Dawson County Superior Court, Georgia.  Guest specifically consents to such jurisdiction and to extraterritorial service of process.

31.  Owner reserves the right to refuse service to anyone Applicant for rental must be a minimum age of 30 and occupy the home for the entire length of stay.  Individuals under the age of 18 must be accompanied by parent or legal guardian. We will accept families, married couples, and responsible adults.  Property is leased without regard to race, color, religion, sex, national origin, or handicap.

32.     Violating AgreementIf Guest violates any of the conditions of this Agreement, Owner may terminate this Agreement and enter property.  Upon notice of termination of this Agreement, Guest shall vacate the property immediately and forfeit all rents and security deposits.
